In Loving Memory of Tiffie

Hello all,

I’ve just lost my baby girl Tiffie today

(Actually at this very moment as I am posting this since it is my girlfriend who is bringing her to the vet-> why? Please read on)

She was just 1 year and 9 months old when she departed us

She was the bravest pup I’ve ever known, fighting against a myriad of disease and sickness before succumbing to a condition known as “Congenital Heart Disease”

I say she was the bravest also because there is a short story behind it and if you guys don’t mind, I’d like to account it here because I want her to be remembered

2 Nights ago, she was fighting for her life and she almost “left” us

Her pupils were dilated and her limbs were rigid and straight

All signs pointing to the fact that she is leaving us

However, after a few moments she suddenly acquired a surge of energy.

My girlfriend and I thought maybe it was the final lease of energy before she “leaves” us.

However she did not go and naturally my girlfriend and I were confused and not to mention sad

Seeing her go through this kind of pain and yet she was so stubborn and refusing to let go although we told her that it’s alright to go.

My girlfriend thinks that maybe there were some things left that she hasn’t done.

(In Chinese culture, we believe that when a person has not done something his/her heart desires so badly, they couldn’t leave)

It then occurred to me that since I was studying overseas, I have not seen my little girl for 9 months now.

I felt guilty as hell and cried like a baby.

And today we decided to end it for her because we really do not want her to suffer anymore

It was the toughest decision we ever made so far

And it was worse for my girlfriend because she has to do it since I was overseas

But we both know it is for the better and this was necessary so that our little one will not have to suffer anymore

She was young, brave, courageous, naughty and cuddlesome all bundled into 1 joyous bundle.

This is her story. This is our Tiffie, our brave little tiger.

**note: Yes I do still feel really guilty for making her wait for me, and the fact that I couldn’t be there till her very end shreds me to pieces. I really hope I can get through this.
I know for a fact that there will not be a single day I won’t think about my little bundle of joy.

I hope my girlfriend and I will get through this and hopefully we will find it in our hearts to share the love that we have given to little Tiffie with another one (=

(BERNAMA) - BERA: The Government cannot guarantee that the prices of petrol, diesel and gas will remain the same if global crude oil prices continue to rise, said Domestic Trade, Cooperatives and Consumerism Minister Datuk Seri Ismail Sabri Yaakob.

Ismail said the Government is expected to fork out RM17bil in fuel subsidy following an increase in the price of crude oil in the global market.

"We cannot assure that the prices will remain the same, including RON 95 petrol, diesel and gas. The prices will be reviewed by a subsidy rationalisation committee every six months. Last year, the subsidy for fuel was RM10.3bil," he told reporters after opening the Bera Division's Pemuda, Wanita and Puteri Umno meetings here Monday.

He said the petrol and diesel price would be decided after the committee's meeting in June.

"If the Government continues to bear the additional subsidy, its deficit will increase," he said. - Bernama

We've all heard the same old same old
But really, how much do we know about human rights?
What are Human rights to be exact?
Are they merely the rights encompassed under the Universal Declaration of Human Rights?
What are the consequences of insisting that Human Rights be abolished?
What are the consequences of insisting that Human Rights be imposed each time?

It is easy to call for a full blown array of Human Rights to be enforced
However, like everything under the sun, it is a grey area
Where do you draw a line?
Does anybody realise the consequences of allowing Human Rights to encompass each and every nook and cranny of our life?

Let me ask you what do you think about news such as this;
Drug Baron claiming for compensations under Human Rights
or
Drug Addict receives £700k

Yes, never mind the drug baron was granted asylum despite the fact that he is a drug baron
(Probably granted asylum due to Human Rights as well)
The authorities can only watch helplessly as they are unable to do anything due to the so called "bars" of Human Rights
This is the same guy is (most likely) financing one of the biggest drug traffickings in the country
Best of all, after being acquitted of drug charges, he turns around to sue the government
The irony of it all

Or what about Right to privacy?
Think of this scenario
The MI5 taps into the phone of a suspected terrorist (which is a breach of Art.8 ECHR btw)
He then listens to elaborate plans of involving the bombing of a kindergarten
Could the MI5 then charge into the hideout of the terrorist to arrest him?

Upon prosecution,
What if the terrorists appeal for the phone conversation evidence to be thrown out due to improper acquisition of evidence due to breach of Article 8 of the ECHR?
They walk away scot free and guess what?
They won't be able to be to be tried for the same offence under Article 6 ECHR
(Double Jeopardy rule)
Damned if they do, Damned if they don't
Caught between the rocks and the deep blue sea

Do you see how Human Rights can sometimes be a hindrance?
It is no wonder that former Prime Minister Tony Blair was so adamant to see the HRA 1998 to be thrown out the window
Is Human Rights imposing too much of a burden on the State?

Let's talk about the Internal Security Act in Malaysia then
Tell me what is the purpose that people are calling for it's abolishment?
Yes it is a draconian Act designed to combat the then communists in Malaya

But what else besides that?
Was it because of the fact that it was used in Ops Lalang?
If that is the case, the problem was with the usage NOT the law
Is the ISA such a problematic law which only seeks to undermines human rights?

Take the case of Mas Selamat
Without ISA, it would have been hard to have arrest him under the normal laws
His charge just will not stick had it gone through the normal process
He will just get away and end up injuring more people
Think of the Ticking Time Bomb Scenario

When you give it more thought you will realise one thing;
Most of the time, the problem does NOT lie with Law
It is the actions of individuals which causes the most problem
It is the exploitation by certain quarters which renders the law draconian

Human Rights law seeks to co-exist with such preventive laws such as the ISA and the ATCSA 2001
It is the wrongful usage that the Human Rights law seeks to prevent

Therefore when a case comes in with full hard evidence of plans to blow up a kindergarten,
Perhaps it would be prudent for the courts to look at the case in its fullest context with all the facts involved
Was the evidence obtained in such a perverse manner that it ought to have been thrown out?

In any case, Article 8 is a qualified right, which means that the State may interfere in certain circumstances
When one looks at the Human Rights to see that not all rights are absolute
That there are indeed certain rights which allows State interference (albeit with legitimate aims)
Only certain rights such as the Right to Life are absolute in nature in the sense that they are non-derogable

The ISA is most certainly useful
I'm not disputing that
However, it can be a devastating weapon when used arbitrarily
Think of that Nanyang Siang Pau Reporter who was arrested for her own safety
Isn't it supposed to be the other way around?
If that is the case, then ISA should arrest all the innocent people

Perhaps it is high time that Malaysia should adopt a law such as the HRA1998
A Human Rights legislation will do Malaysia good as this helps keeps certain quarters in check
And the courts MUST be fearless in terms of applying the law

The solution is not to repeal the ISA
The solution lies in adopting a human rights act
Coupled with fearless application, the usage of that "draconian" law will automatically regulate itself

Remember Human Rights does not hinder, it seeks to co-exist as a check and balance to prevent arbitrary usage of the law

It was a miracle that I was still able to wake up and get myself to London

An Epiphone Les Paul Custom?!
Well, surprise, the above is not an Epiphone Les Paul Custom
Neither is it tailored specifically for me =p
She is an Indie Guitar Co. ILP Gotoh Floyd Rose
Founded in England and Manufactured in Korea

MiK = Epicness in quality

I know I am not even 60% good yet
But I know a good sound when I hear one
*No I'm not biased =p
The tone is as ballsy as a Gibson
(I bet if you replaced the Humbuckers with a Gibson burstbucker you'd probably suckered yourself into believing it to be an actual Gibson =D)
But that said, it can never be compared to a Gibson
It's like a Gibson but its just not
But hey for the price, I'm satisfied =D
But I'd say it surpassed the Epiphone LP Custom though

It's solid and has a nice feel
The set neck is perfect for accessing the upper frets
(in particular the 21st-22nd frets)
The best thing about this guitar is that
I do not have to worry about meeting someone with the same guitar in Malaysia
I think all in all there would be less than 100 players with this guitar in Malaysia
An Indie Guitar, nobody knows about it sadly
And I have to admit that I've stumbled upon this beauty by chance as well
(On e-bay too.. tell me about the scare)

It's a well known general rule that you shouldn't buy guitars off E-bay
This is due to the scams and what not
But all in all, this guitar isn't famous enough to be replicated... yet
So I decided to go for it
(Anyway consumer protection in the UK is a very big thing)
The DV8 pickups are alright, not as heavy as I'd like it to be but still sounds good
(Maybe I need to up my skill levels first =p)

So because I'm not good at this yet
(Neither have I found out how to record the audio and visual yet)

CNY Eve we had dinner with occupants of House 64 and 60 of Miskin Street
(Don't ask me why it's called Miskin Street maybe they wanna be miskin.. beats me)

CNY Chor Yat we had Bakuteh mmmMMMmmmm
(When you have not have had bakuteh for 8 friggin' months, it feels like heaven)
I swear If you're Chinese and dislike bakuteh = blasphemy =_=

Second Day we had another dinner - Steamboat =D

Yoz...
So it's been quite a while since I've blogged..
I blame the hectic education system I'm in..
But I'm actually loving it
I am already feeling very independent-ish
Education-wise as well as Self-Independent-ish

Lots have happened since my absence
Got new boots, cooked a lot (and I mean A LOT!), learning John Petrucci's "Wishful Thinking"
etc etc..
Made some new friends
Still yet to have any British friends hmmm...
I think it's cause of the halls I'm in..
My flatmates are all Malaysian haha..
It's great to have em around
But I feel it's also good to widen my networks so yeah...

What else?
Hmm.. No culture shock as of now...
Fitting in with the education system
(I've found my hardworking-ness again)
Got new goal in life, Working hard towards it
Surprisingly I've not drunk as much beer as I've expected to have drunk
Beer isn't as cheap as people say.
But it sure as hell is cheaper than Malaysia...

Finally,
After so long
I can finally say
I am at Cardiff/Caerdydd!

I know baby girl is missing me alot

I want her to know she runs through my mind every other day
I am happy and enjoying here

Anyhow Cardiff is great
Getting chilly since its early Autumn
My room is fantastic
(it had better be considering the price my parents paid)
Had the biggest spending after a long time
To get everything done from internet to fees to bedding
but almost everything is settled now
We should see a drop in expenses..

The only thing left is my Phone
Which I have to wait for my bank card to be eligible to apply for a postpaid plan
(yes the one with free phone)
Not only that but the plans are surprisingly much more value for money compared to pre-paids
So I guess Phones will only come in about 2-3 weeks time..
Meanwhile I'll be using Lebara..
However I feel a little reluctant to reload 5 quids in...
For fear of lack of usage..
Guess its just wait and see

There will be enrollment tomorrow..
Surprisingly I am able to wake up on time and early
Probably my time still adjusted to Malaysian Timing
So my 7am is like Malaysian 2pm

Yep that's how long I've been working
And yes I know its not as long as some of who has reached half a decade
Or a decade or 3 years or whatever

However this is not my first job
And I'm proud to say that I'm definitely not some rich asshole
Who just bum around the house during the holidays..
I've started working as early as 16 years old (I know some of you did it even younger)
Then 18, 19, 20 and finally this year...

I've gone through fairs, office jobs, promoters
I think it is just fair that I should be able to say
That I have pretty much done 50% of the odd jobs if not 70%
(minus the street sweeper, waiter and etc etc)

Now on to what I've learnt
When someone comes to you and say

"Son, find a job that you love to do, 'cuz you'll be doing it for the rest of your life"

He is probably 99.99% right..
So take heed.. -____________-
Suffice to say I do not really enjoy what I'm doing
And TBH, I'll be damned if I have to go through this for the rest of my working career
So no way...

No I'm not a spoilt brat
Don't tell me you love manual jobs?
If you do.. then God bless your merry little hearts
But if you love manual jobs then I love the opposite

I love jobs which are challenging in nature
That I have to actually use my God given brains to tackle
I love jobs which requires you to think
To be able to adapt to different situation instead of going by the book

Truth be told, if I can do something which I do not like half halfheartedly
And yet be able to complete it and to be able to get it as near to perfection as possible
I wonder what I can do if I put my heart and soul into it

TBH, I still haven't got a clue what I want to do in the future
As I've said, anything goes as long as I like it and if the pay is decent
I'll do it.
Of course till I get a degree, I can't really complain
But when I DO get my degree
*Which I eventually will, hopefully (wtf am I saying? I MUST!)
Then that's when I have to weigh my options

Working has taught me that almost every other thing uses common senses
Your common senses are free.. Use them!
However, the problem appears when you've lost touch of something

It could be the big boss who has loss touch with his roots
It could be that superior who has forgotten what it was like to be in your shoes
And God forbid, I should ever loose touch with the ground
That is why I'm writing this
To remind myself what it is like to be on the ground
What your workers actually feel when you make a simple decision
That decision affects them!
Think before you decide!

Managing uses lots of common sense
Your workers are like your engine
You can be a sleek looking sports car
But without your engines, You're going no where brother!
Your decision affects them
To press the accelerator (make decisions) is easy
But your engine is tearing apart (workers overworked)
Without proper maintenance (rewards/promotions/incentives etc)
Your engine will wear out (workers will leave)

So it's just as I've said
It's simple common sense
(of course there are other factors)
Such as the god damned air conditioners (Board of directors)
Which sometimes loves to throw a hammer in to your works every once in a while
But solving them is easy if you know how

Note that I do not read books on managing
Neither do I attend courses on it
And I sure as hell do not have a degree in Management or relating to it
I damn sure have not studied it
It's common sense
And while my example is an over simplistic view
It is pretty much the basic framework..
Tell me I'm wrong
I'm willing to listen and be corrected

I'm telling this to my future self now
If I ever ever get myself into a managing position
With a bunch of guys under me
I must

1) Understand them
2) Give them chances to be who they are
3) Listen to them
4) Take time to get to know them
5) Honor your own promises to them
6) Manage them not control them
7) Allow creativity
8) Give credit where it is due
9) Discipline is a must but not to the point of torture
10) You get them to do things by having them do it voluntarily
11) One way or the other they will do it but the outcome depends mostly on how they were asked to do it
12) Be strict but not control freak
13) Value their opinions (they are smarter than you think)
14) Not everybody is motivated by money and perks

Well..
At first, I had thought of blogging about the awesome night that was the Slash Concert

However, even that great event was marred by something awful
Something terrible

And now
Here I am...
Having just attended a funeral service...
Its unlike any other funeral service..
This funeral service was in honor of a boy a year younger than I..

I have always related death and funeral services with old people
It suddenly dawned upon me
Smack right in the middle of my face much like a face palm...
That Death.. could happen to anyone..
Me, You, Them, Him, Her..
Death does not discriminate..

Suddenly I felt like Life was as thin as paper
As fragile as glass
It could be blown away, or shattered just like that...

As I stood there talking away with my friends
I just couldn't help thinking at the back of my mind
Why would someone so healthy just die like that?
I can only rationalize that God probably loved him more
He wanted him more than anybody else to have him by His side...

Was the only reassuring comfort that I could find

Although I did not know him
I've seen him around
I know his brother

JULY 31 — Thank you for inviting me to speak with you. I am truly honoured. I have played some small role in the life of this nation, but having been on the wrong side of one or two political fights with the powers that be, I am not as close to the young people of this country as I would hope to be. History, and the 8 o’clock news, are written by the victors. In recent years the government’s monopoly of the media has been destroyed by the technology revolution.

You could say I was also a member of the UKEC. Well I was, except that belonged to the predecessor of the UKEC by more than fifty years, The Malayan Students Union of the UK and Eire. I led this organisation in 1958/59. I was then a student of Queen’s University at Belfast, in a rather cooler climate than Kota Bharu’s.

Your invitation to participate in the MSLS was prefaced by an essay which calls for an intellectually informed activism. I congratulate you on this. The Youth of today, you note, “will chart the future of Malaysia.” You say you “no longer want to be ignored and leave the future of our Malaysia at the hands of the current generation.” You “want to grab the bull by the horns... and have a say in where we go as a society and as a nation.”I feel the same, actually. A lot of Malaysians feel the same. They are tired of being ignored and talked down to by swaggering mediocrities.

You are right. The present generation in power has let Malaysia down.

But also you cite two things as testimony of the importance of youth and of student activism to this country, the election results of 2008 and “the Prime Minister’s acknowledgement of the role of youth in the development of the country.”

So perhaps you are a little way yet from thinking for yourselves. The first step in “grabbing the bull by the horns” is not to required the endorsement of the Prime Minister, or any Minister, for your activism.

Politicians are not your parents. They are your servants. You don’t need a government slogan coined by a foreign PR agency to wrap your project in. You just go ahead and do it.

When I was a student our newly formed country was already a leader in the postcolonial world. We were sought out as a leader in the Afro-Asian Conference which inaugurated the Non-Aligned Movement and the G-77. The Afro-Asian movement was led by such luminaries as Zhou En-lai, Nehru, Kwame Nkrumah, Soekarno. Malaysians were seen as moderate leaders capable of mediating between these more radical leaders and the West. We were known for our moderation, good sense and reliability.

We were a leader in the Islamic world as ourselves and as we were, without our leaders having to put up false displays of piety. His memory has been scrubbed out quite systematically from our national consciousness, so you might not know this or much else about him, but it was Tengku Abdul Rahman established our leadership in the Islamic world by coming up with the idea of the OIC and making it happen.

Under his leadership Malaysia led the way in taking up the anti-apartheid cause in the Commonwealth and in the United Nations, resulting in South Africa’s expulsion from these bodies.

Here was a man at ease with himself, made it a policy goal that Malaysia be “a happy country”. He loved sport and encouraged sporting achievement among Malaysians. He was owner of many a fine race horse.

He called a press conference and had a beer with his stewards when his horse won at the Melbourne Cup. He had nothing to hide because his great integrity in service was clear to all. Now we have religious and moral hypocrites who cheat, lie and steal in office but never have a drink, who propagate an ideologically shackled education system for all Malaysians while they send their own kids to elite academies in the West.

Speaking of football. You’re too young to have experienced the Merdeka Cup, which Tunku started. We had a respectable side in the sixties and seventies. Teams from across Asia would come to play in Kuala Lumpur. Teams such as South Korea and Japan, whom we defeated routinely. We were one of the better sides in Asia. We won the Bronze medal at the Asian games in 1974 and qualified for the Moscow Olympics in 1980. Today our FIFA ranking is 157 out of 203 countries. That puts us in the lowest quartile, below Maldives (149), the smallest country in Asia, with just 400,000 people living about 1.5 metres above sea level who have to worry that their country may soon be swallowed up by climate change. Here in ASEAN we are behind Indonesia, Thailand, Singapore, whom we used to dominate, and our one spot above basketball-playing Philippines.

The captain of our illustrious 1970’s side was Soh Chin Aun. Arumugam, Isa Bakar, Santokh Singh, James Wong and Mokhtar Dahari were heroes whose names rolled off the tongues of our schoolchildren as they copied them on the school field. It wasn’t about being the best in the world, but about being passionate and united and devoted to the game.

It was the same in Badminton, except at one time we were the best in the world. I remember Wong Peng Soon, the first Asian to win the All-England Championship, and then just dominated it throughout the 1950. Back home every kid who played badminton in every little kampong wanted to call himself Wong Peng Soon. There was no tinge of anybody identifying themselves exclusively as Chinese, Malays, Indian. Peng Soon was a Malaysian hero. Just like each of our football heroes. Now we do not have an iota of that feeling. Where has it all gone?

I don’t think it’s mere nostalgia that that makes us think there was a time when the sun shone more brightly upon Malaysia. I bring up sport because it has been a mirror of our more general performance as nation. When we were at ease with who we were and didn’t need slogans to do our best together, we did well. When race and money entered our game, we declined. The same applies to our political and economic life

Soon after independence we were already a highly successful developing country. We had begun the infrastructure building and diversification of our economy that would be the foundation for further growth. We carried out an import-substitution programme that stimulated local productive capacity. From there we started an infrastructure buildup which enabled a diversification of the economy leading to rapid industrialisation. We carried out effective programmes to raise rural income and help with landless with programmes such as FELDA. Our achievements in achieving growth with equity were recognised around the world. We were ahead of Our peer group in economic development were South Korea, Hong Kong, Singapore and Taiwan, and we led the pack. I remember we used to send technical consultants to advise the South Koreans.

By the lates nineties, however, we had fallen far behind this group and were competing with Thailand and Indonesia. Today, according to the latest World Investment Report, FDI into Malaysia is at about a twenty year low. We are entering the peer group of Cambodia, Myanmar and the Philippines as an investment destination. Thailand, despite a month long siege of the capital, attracted more FDI than we did last year. Indonesia and Vietnam far outperform us, not as a statistical blip but consistently. Soon we shall have difficulty keeping up with The Philippines. This, I believe, is called relegation. If we take into account FDI outflow, the picture is even more interesting. Last year we received US$1.38 billion (RM4.40 billion) in investments but US$ 8.04 billion flowed out. We are the only country in Southeast Asia which has suffered nett FDI outflow. I am not against outward investment. It can be a good thing for the country. But an imbalance on this scale indicates capital flight, not mere investment overseas.

Without a doubt, Malaysia is slipping. Billions have been looted from this country, and billions more are being siphoned out as our entire political structure crumbles. Yet we are gathered here in comfort, in a country that still seems to ‘work.’ Most of the time. This is due less to good management than to the extraordinary wealth of this country. You were born into a country of immense resources both natural and cultural and social. We have been wearing down this advantage with mismanagement and corruption. With lies, tall tales and theft. We have a political class unwilling or unable to address the central issue of the day because they have grown fat and comfortable with a system built on lies and theft. It is easy to fall into the lull caused by the combination of whatever wealth has not been plundered and removed and political class that lives in a bubble of sycophancy.

I urge you not to fall into that complacency. It is time to wake up. That waking up can begin here, right here, at this conference. Not tomorrow or the day after but today. So let me, as I have the honour of opening this conference, suggest the following:

Overcome the urge to have our hopes for the future endorsed by the Prime Minister. He will have retired, and I’ll be long gone when your future arrives. The shape of your future is being determined now.

Resist the temptation to say “in line with” when we do something. Your projects, believe it or not, don’t have to be in line with any government campaign for them to be meaningful. You don’t need to polish anyone’s apple. Just get on with what you plan to do.

Do not put a lid on certain issues as “sensitive” because someone said they are. Or it is against the Social Contract. Or it is “politicisation”. You don’t need to have your conversation delimited by the hyper-sensitive among us. Sensitivity is often a club people use to hit each other with. Reasoned discussion of contentious issues builds understanding and trust. Test this idea.

It’s not “uber-liberal” to ask for an end to having politics, economic policy, education policy and everything and the kitchen sink determined by race. It’s called growing up. Go look up “liberal” in a dictionary.

Please resist the temptation to say Salam 1 malaysia, or Salam Vision 2020 or Salam Malaysia Boleh, or anything like that. Not even when you are reading the news. It’s embarrassing. I think it’s OK to say plain old salam the way the Holy Prophet did, wishing peace unto all humanity. You say you want to “promote intellectual discourse.” I take that to mean you want to have reasonable, thought-through and critical discussions, and slogans are the enemy of thought. Banish them.

Don’t let the politicians you have invited here talk down to you.

Don’t let them tell you how bright and “exuberant” you are, that you are the future of the nation, etc. If you close your eyes and flow with their flattery you have safely joined the caravan, a caravan taking the nation down a sink hole. If they tell you the future is in your hands kindly request that they hand that future over first. Ask them how come the youngest member of our cabinet is 45 and is full of discredited hacks? Our Merdeka cabinet had an average age below thirty. You’re not the first generation to be bright. Mine wasn’t too stupid. But you could be the first generation of students and young graduates in fifty years to push this nation through a major transformation. And it is a transformation we need desperately.

You will be told that much is expected of you, much has been given to you, and so forth. This is all true. Actually much has also been stolen from you. Over the last twenty five years, much of the immense wealth generated by our productive people and our vast resources has been looted. This was supposed to have been your patrimony. The uncomplicated sense of belonging fully, wholeheartedly, unreservedly, to this country, in all it diversity, that has been taken from you.

Our sense of ourselves as Malaysians, a free and united people, has been replaced by a tale of racial strife and resentment that continues to haunt us. The thing is, this tale is false.

The most precious thing you have been deprived of has been your history. Someone of my generation finds it hard to describe what must seem like a completely different country to you now. Malaysia was not born in strife but in unity. Our independence was achieved through a demonstration of unity by the people in supporting a multiracial government led by Tengku Abdul Rahman. That show of unity, demonstrated first through the municipal elections of 1952 and then through the Alliance’s landslide victory in the elections of 1955, showed that the people of Malaya were united in wanting their freedom.

We surprised the British, who thought we could not do this.

Today we are no longer as united as we were then. We are also less free. I don’t think this is a coincidence. It takes free people to have the psychological strength to overcome the confines of a racialised worldview. It takes free people to overcome those politicians bent on hanging on to power gained by racialising every feature of our life including our football teams.

Hence while you are at this conference, let me argue, that as an absolute minimum, we should call for the repeal of unjust and much abused Acts which are reversals of freedoms that we won at Merdeka.

I ask you in joining me in calling for the repeal of the ISA and the OSA. These draconian laws have been used, more often than not, as political tools rather than instruments of national security. They create a climate of fear. These days there is a trend among right wing nationalist groups to identify the ISA with the defence of Malay rights. This is a self-inflicted insult on Malay rights. As if our Constitutional protections needed draconian laws to enforce them. I wish they were as zealous in defending our right not to be robbed by a corrupt ruling elite. We don’t seem to be applying the law of the land there, let alone the ISA.

I ask you to join me in calling for the repeal of the Printing and Publications Act, and above all, the Universities and Colleges Act. I don’t see how you can pursue your student activism with such freedom and support in the UK and Eire while forgetting that your brethren at home are deprived of their basic rights of association and expression by the UCA. The UCA has done immense harm in dumbing down our universities.

We must have freedom as guaranteed under our Constitution. Freedom to assemble, associate, speak, write, move. This is basic. Even on matters of race and even on religious matters we should be able to speak freely, and we shall educate each other.

It is time to realise the dream of Dato’ Onn and the spirit of the Alliance, of Tunku Abdul Rahman. That dream was one of unity and a single Malaysian people. They went as far as they could with it in their time. Instead of taking on the torch we have reversed course. The next step for us as a country is to move beyond the infancy of race-based parties to a non-racial party system. Our race-based party system is the key political reason why we are a sick country, declining before our own eyes, with money fleeing and people telling their children not to come home after their studies.

So let us try to take 1 Malaysia seriously. Millions have been spent putting up billboards and adding the term to every conceivable thing. We even have cuti-cuti 1 Malaysia. Can’t take a normal holiday anymore.

This is all fine. Now let us see if it means anything. Let us see the Government of the day lead by example. 1 Malaysia is empty because it is propagated by a Government that promotes the racially-based party system that is the chief cause of our inability to grow up in our race relations. Our inability to grow up in our race relations is the chief reason why investors, and we ourselves, no longer have confidence in our economy. The reasons why we are behind Maldives in football, and behind the Philippines in FDI, are linked.

So let us take 1 Malaysia seriously, and convert Barisan Nasional into a party open to all citizens. Let it be a multiracial party open to direct membership. PR will be forced to do the same or be left behind the times. Then we shall have the vehicles for a two party, non-race-based system.

If Umno, MIC or MCA are afraid of losing supporters, let them get their members to join this new multiracial party. PR should do the same. Nobody need feel left out. Umno members can join en masse. The Hainanese Kopitiam Association can join whichever party they want, or both parties en masse if they like. We can maintain our cherished civil associations, however we choose to associate. But we drop all communalism when we compete for the ballot. When our candidates stand for Elections, let them ever after stand only as Malaysians, better or worse.

Now let’s have a discussion.

When Soon and Later gets Mis-used

I uber duper hate it when words gets misused
No I don't mean misused in the "meaning" kind of way
What I mean is
When people use it to procrastinate.

Don't get me wrong..
I'm not against it when you really need to use it
But when you use it to escape responsibilities
I think you have a problem with life

Everybody uses it sometimes
Myself included
So no, this is not a "holier-than-thou" post
*After this, I'll kill anybody who says "You're not so perfect yourself"
I'm guilty of it as well
I use it to escape sometimes

But when one uses it to the point
It becomes annoying or hateful even
Then that's where the problem is

When someone uses "later"
It means that he/she will do it in say a span of 5 minutes or maybe 2-3 hours
Depending on what it is and its priority
Say for example

"A's mum asks A to bring the clothes back in...
The sun is still shining and its a hot day,
A says later"

By all means, I feel that the usage of the word is justified in that scenario
Of course it should be followed by the action of doing what he said he would do!

"A later went out and brought the clothes back in"

Then the usage of the word is perfectly justified!

Now take another scenario

"B's mum asks B to clean up after her OWN pet's poop
B said later or soon.
5 hours later and after 329482942 nags from her mum
B finally does it"

This is the situation where I am utterly disgusted at the way the word was used

I mean, I don't know how many of you have pets
But when pets litter or pee in the house,
For some reason the surrounding floor becomes sticky
It's uncomfortable
This is where priority comes in
If you're not saving a life,
Would 5 minutes, spared to clean up the mess,

a) Kill you?
b) Make you loose 1 whole bloody chapter of that book you're reading?
*There is such thing called a bookmark you know ._.
c) Miss an entire scene of the movie you are watching on your laptop
*There is such a thing called the "pause button" on the video player.. Use it dimwit!

Heck even if you're rushing your assignments
Would it fail you to spare 5 minutes to do it?

This is not the entire problem mind you
When done often enough,
People starts to get sick of that "soon" or "later" word
To the point where even if its justified to use it
People tend to get impatient

That asshole, B, just made life more difficult for her siblings
To me, that person knows nothing about prioritizing goals in life
Short term or long term, it doesn't frickin' matter
He/She just does NOT know how to. period.
*best example, Party/trip with friends over Driver's License classes

Why do I say that?
When you procrastinate with this 2 words long enough
Your "soon" and "later" no longer holds any value
Those two words denotes that you do not wish to do it
And you're procrastinating indefinitely
That's when the nagging comes
And when nagging comes, people become stressed
When people become stressed they do crazy things
*I eat people when I stressed .__.

Now when other people uses the "two-words-which-must-not-be-said"
People tend to remember the second scenario
It's easy to forgive, but hard to forget!
And that's why I said, that A-Hole, B, just made life difficult for everyone!

Speaking of responsibilities,
I also tend to hate people who does not have any sense for responsibilities
I also know it don't matter who I hate
But think of it as a general hate
I'm willing to bet my ass that this problem annoys almost everyone
Except for those with the same shitty attitude
If I'm wrong you can screw my ass with anything you like
I doubt I am though

If you want to keep a pet
You are responsible to it
You do NOT just leave it there upon buying it
You're responsible for his well being even when it is no longer cute
Or cuddly or funny

Once in a while, yes it is okay we stand in for you
When you are busy or something *genuinely of course*
Don't tell me to bathe your dog when you're watching drama or shit

A good example would be..
A rich man son..
Father being so rich, gave 10% of his wealth to his son to start a business..
The son will fool around with 5% of the wealth
(cars, girls, lifestyle etc)
He then proceeds to open a chain of franchise restaurant (Paparich, Old Town)
At one corner of a busy street
Expensive yes, Overheads high, yes
But so what?
His dad is rich
And after 2-3 years, his business breaks through
He gets richer

Compare to that of a poor man

No capital to start up business
No money to gain education
He goes no where
He stays poor

Compare with a middle class man
He has decent education
Starts up a business via capital saved over 5 years of hard work
He can only afford the shop lot next to the rich man...
And couldn't afford to get a franchise licence
Long run, he looses out to the rich man
He just couldn't sustain the overheads
He closes down shop
Lost over 5 years worth of savings

Note:
The rich man might not be particularly bright
Who needs to when all you need to do is wait till your business gives you a profit
All you need to do is outlast your opponent who are not as well to do as you

If you can still fail and loose your wealth as a rich man or his son
You are stupid man...

My Impression

My first action was to simulate the distortion on my amp
Turned the gains to the highest
Turned up the bass and treble
Tweak the presence

On my Special II
Increased the Tone
And voila.. There you have it..
Distortion!

I've tried it on my Pacifica..
But yet it did not sound anything rock-ish or metal-ish
But the moment I strummed it
I was stunned =D
Happeh happeh happeh!

The sound was crazily awesome
It was like.. what I heard on radios..
And I couldn't stop playing (maybe cuz new toilet bowl =D)

For advanced beginners I really recommend this guitar
Simply because its the best for its price range
RM7xx (not going to tell the price.. you gotta ask the person I dealt with)

Okay...
So I have been contemplating about this for while now
As much as my beloved Yamaha Pacifica is my first guitar
The truth is..
It can't do the stuff I want it to do )=
If you guys know me..
I actually love guitar because of certain influences
Influences like Avenged Sevenfold, Sum41,
They make us of distortion, harmonic pinches
Heavy metals stuff, shredding, solo-ing
Melodic Lead, such as Neil Zaza, Slash(okay he is pretty heavy), Jerry C, Funtwo
Yeah those are the type of music (that guitars can make) that I like
I don't mind the occasional Blues, and Jazz as well

And finally, I have made my decision
I'm going to take shredding, solo classes
(after my exams of course.. oh that glorious-exam-free-moment)
And knowing that my current Pacifica can't actually handle that type of sound
I decided to ask around and make some inquiries

It all started when I saw this post on LYN
K so from that post, I got to his blogshop
And I saw this post
Well this deadeyes guy don't post his prices online
Perhaps maybe to give a better offer?
I don't know.. That is his business lol

So anyhow..
I got pretty interested with the Ibanez GRX70DXj Jumpstart Kit
It comes with everything you need to start playing!
I dropped him an email asking for the price
Well actually I sorta gave up already
I thought the price would somehow exceed RM1k (beyond my budget)
At that time I was thinking of second hand guitars (of course quality ones la)
Being an Ibanez I know it's quality wont go much wrong
I dropped him an email stating that I was interested
And that I have a budget,
And (Possibly the turning point) told him what sort of music style I was into

He replied me stating the price for the Jump start kit was actually only
GUESS!

*boy I was excited at the figure
Even if it was just a jumpstart kit ( Ibanez guitars won't go wrong )

He would try to find a good shredding/heavy jam type guitar which suits that budget range

An Epiphone Les Paul Special II
Needless to say I googled those models immediately
He told me the Ibanez would be good for shredding
The Les Paul would better for heavy stuff/and shredding to a certain extent
Needless to say the Les Paul was more expensive (=
By RM50..
(and that gap has since closed.. to how much I won't tell)
(lets just say I'm pretty happy with the figure)

*so if you guys are new to this, and interested, I'd say go for this package
3) Reviews put the Ibanez grg170dx and the Epiphone LP SP II to be more of a advanced/starter player..

The Utter Tyranny of Detention Without Trial - a very true and recent story

Most of you may have read that Azean Irdawaty's son, Benjy, was recently arrested for apparently in possession of 800grams of cocaine, and 140grams of methamphetamine. If true, that would make him a presumed trafficker under our law. The death sentence would be staring at his face.

However, they only charged him with being in possession of 0.24grams of metaphetamine. What happened to the 800 grams of cocaine? And 139.76 grams of metaphetamine which he supposedly have?

To top it up, today, the Star reported that the "powder" found was not cocaine after all!

After bail was granted, he was re-arrested under the Dangerous Drugs (Special Preventive Measures) Act 1985. This Act is the drug version of the ISA. It allows detention without trial.

In addition, Amer Hamzah, his lawyer, was manhandled by the police. Lawyers are planning a protest walk tomorrow.

On March 11th, he was arrested at his apartment's parking lot in Segambut. Police brought him to an apartment he rented in Kepong, and after entering, claimed that in that residence, he possessed 800grams of cocaine, and 140grams of methamphetamine, and accused him of processing and trafficking, putting him under the risk of being charged under Section 39B, which carries the death penalty.

On March 12th he was remanded for 7 days. When my parents inquired if we can engage a lawyer, the Investigation Officer told us "No need".

On March 17th, after our family waited more than an hour, we were allowed to see him for the very first time, under supervision.

Again my mother asked if we should get him a lawyer, again the I.O advised against it, claiming "Lawyer tak boleh buat apa-apa sekarang. Buang duit je. (Lawyer can't do anything now. It's simply a waste of money)."

On March 18th, his remand was extended another 7 days. The magistrate inquired why there was no lawyer present for him, and whether he was made aware he had the right to a counsel of his choice. He replied "No." Therefore, he requested for one, and only nine hours later, did the I.O call to inform my mother, who promptly engaged Amer Hamzah Arshad. But the very next day, the police used their Executive authority under Section 28A that vetoed his right to a counsel. All requests made by our lawyer to visit him was denied.

Only after we complained to SUHAKAM, did the police allow Amer to visit him.

On the last day of his remand. After the investigations were concluded. For only 15 minutes.

On March 25th, he was brought to court, and charged under Section 12(2) for possession of 0.24grams of metaphetamin in his Segambut residence. Nothing the police claimed they found in the Kepong residence, the cocaine and shabu that was "already packaged to be distributed" or the so called "cocaine processing mini-lab" was brought to court.

Because there WAS none.

He was released on bail. A trial date was set. He was so close to being free, and seeing his 4 year old son again.

But as he was signing the papers of his release, the Plainclothes were outside waiting.

Not two steps after he came out of the bail department, without any explanation, they re-arrested him. Amer was restrained from protecting him, and only after Amer repeatedly asked them to show their I.D, did they do so. Still, no explanation was given to the family. We were merely told to go to the Headquarters and speak to Inspector Kang. The same guy who claimed my brother possessed the cocaine they NEVER found.

He never saw us, he was "in a meeting." He wasn't too occupied to give the press a statement, but was unavailable to see us.

We were told by the new I.O for this case, and the DSP (the guy who signed the papers denying my brother the right to a counsel) that they are detaining him for 60 days under the Special Preventive Measures Act (LPK), after which, they could further detain him for 2 years if found guilty.

Guilty according to THEM. For under this act, it is a detention without trial, like the Internal Security Act. Any information gathered from "witnesses" and "investigations" will never be disclosed to him or his lawyer, or the court. He will also not be able to defend himself against any allegations. Under this act, he will never have his day in court.

On March 25th, my brother, Ben, was denied his Constitutional rights.

For 2 weeks, our family went through hell. Sleepless nights, press waiting outside our door, Ben had asthma attacks after the police delayed themselves in acquiring the requested medication for 3 days, Mama, who is a cancer patient herself, suffered chest pains and lost her voice.

We felt it was all worth it, for we would be able to have him back.

But now, a new nightmare has begun.

Whether or not Ben is guilty, should not be for the Police to decide. If they HAD the evidence to strengthen their warrant for re-arrest, why was it not brought to court? Why is Ben not given a chance to defend himself? How can we ever know the authenticity of these so called witnesses and their statements? If there were ANY to begin with?

Under this act, I could simply be caught for any crimes of drug offences the police accuse me of, because they can claim they have enough information (even if they have absolutely nothing) and detain me. For 60 days, for 2 years, and even EXTEND it after.

Acts like this and the ISA are licenses for ARBITRARY arrest and detention. Anytime. Anywhere. Anybody.

My family and Amer will not back down. We will fight for Ben's right. We will speak up for all of those who were silenced before us, who will be silenced hereafter.

But we seek your help. In any way at all, help us fight this. Re-post this, write on your blogs, write to your local representative, to our newspapers, and together we shall use our voice, our art, our space, to stand up not just for Ben, but for all our rights.

Liberty is a Constitutional right. It's time to get it back.

I have said it many times and I will say it again. Detention without trial is inhuman, unjust and is an affront to civil society. It causes more damage than the damage which it is designed to avert.

And it breeds abuse. And laziness on the part of our authorities. Why bother to investigate when the so called "bad guys" could be detained without trial?

The above story is but ONE of the thousands of untold stories about detention without trials.

It is but ONE of the agony, anguish and anger which is felt about this utterly uncivilised affront to fundamental liberties.

Today..
I woke up Effing early at 7am
I thought class was at 10am
When I was halfway there
I realized that I actually had to teach tuition at 9.30am
I messaged my students telling them I had an early class
And that's why I have to postpone class

I reached college
Realized that Class was at 12pm actually
FML #1
Fine so I waited and did some notes on Burden and Standard of Proof
At 9.30am, the college messaged me saying
"Class is canceled because Lecturer had some emergency"

So I woke up early for nothing
And canceled my tuition class for nothing

Please mind where you step, the floor in the 10^th dimension can get a bit runny, and the walls in the 17^th dimension disintegrate altogether. Of course, by the 20^th dimension, the telescopic ceiling will evaporate for your mental safety, but you’ll not be able to forget the pregnant pull of event horizons on your body I promise you that. No, please don’t touch that, the material feels and shatters like wedding china.

If you look to your mirror left you should find the bloated gases of infant galaxies comforting, and to your asymmetrical right you may see carbon planets coalescing in the dense, elemental heat. Ah, yes, the explosion of faraway bangs gravid with potential, peaceful isn’t it? I must warn you, Time will dance with the oscillating furnishings before you, and after you, if you pay close attention, but, only briefly, and only with your permission.

Are you chilly? I’m sorry, but I have only a blanket of anticipatory silence to offer you. Stay close, the perverted mobiüs strips of these corners can cause confusion and loss of coordination.

It's really tough being a Judge. Really, I think it's a thankless job. A Judge can never do any right.

I think it was in 1996 that a soon-to-be-really-famous High Court Judge politely asked me and my opponent whether we would mind to remain in his chambers for some small talk after we had finished our hearing before him. As I had no other case to do, I obliged the Judge. So did my opponent.

He asked both of us how long we had been practising. I told him I had practised for about 10 years. He smiled and said that I could be a Judge soon (as the Federal Constitution states that a person who has been a lawyer for 10 years or more could be a Judge).

I was wondering what was in the Judge's mind. He looked tired. Something was bothering him. He looked and behaved almost like he was resigned to the hopelessness of it all. He was looking at both me and my opponent intently. There was something that he wanted to say but couldn't.

Finally he asked, "what do you think of justice?" My opponent was senior to me and so he answered first. I can't really remember what my opponent said. After he had finished saying his piece, the Judge looked at me. "What do you think?" he asked me.

I looked at him and without hesitation I said, "Judge, I don't believe in justice!" He was petrified! I know he was going to ask why the hell I was practising law then. Before he did so, I continued, "Judge, human beings are incapable of dispensing justice. Only God can do so. Justice is subjective. The winning party will say they have got justice. The losing party will never say so."

The Judge was unimpressed. He looked deep in thought. He was clearly ruffled by what I had just said. Finally, he said, "could you then tell me what me and all my brother Judges have been doing all these while. And what you and your learned friends have been doing appearing before us?"

"Judge, I am a law practitioner, not a justice practitioner. You and your brother Judges have been dispensing the law all these while. You have been applying the law. In modern societies like ours, adherence with and applying the law brings the connotation that justice is being done. That's it. Justice is a connotation. It is not real. It is a corollary of the application of the law by the Court or Judge. The real justice will only be seen when we all die."

"The law is not always just. Take the land acquisition law for example. How just is a law which permits the Government to force a landowner to surrender his land to the Government? But if the law is applied and the Court imposes a suitable compensation to be paid to the landowner, the perception is that justice is done, but is it really done?" I postulated.

"My God", the Judge said. My opponent was cringing in his seat. "I have never thought about it that way,thank you for telling me," the Judge said, his eyes brightened up a bit.

We continued to chat for a bit after that. I was telling him that jurisprudentially, I belonged to the positivist school of jurisprudence. I believe that the law and morality should be separated. After about 20 minutes, we excused ourselves. As we were going out from his chambers, the Judge said, "have a good life both of you."

We thanked him. That was the last time I appeared before that particular Judge. Two or three months later, he rocked the Judiciary with his resignation. The reason for his resignation rocked the whole Malaysia and even the world. But life goes on in this country of ours. Nothing ever changed. People like this Judge just disappear from the map and from our memory.

I last met him in an event in Subang Jaya some months ago. He was still his jovial friendly self. And he looked much happier. May God bless him with a long and healthy life as well as peace of mind.

Fast forward to the present time.

When Justice Ariff Yusof (then he was a Judicial Commissioner) dismissed Gobind Singh Deo's suit against the speaker of the Parliament for suspending him (Gobind), many articles were written and posted on the net about it. Justice Ariff was questioned why he did not follow the Federal Court's decision in one of the Perak Menteri Besar constitutional circus. The Federal Court had in one of those cases held that the Court could review the decision of a Speaker.

Under the law, a decision of a higher court is binding on a lower court. Thus the decision of the Federal Court (which is the highest court in the land) would be binding on the High Court (where Justice Ariff sits).

In dismissing Gobind's suit against the Speaker of Parliament, Justice Ariff applied the clear wording of the law as stated in the Federal Constitution, which says:

"The validity of any proceedings in either House of Parliament or any committee thereof shall not be questioned in any court."

Justice Ariff opined that while the Federal Court recognised the power of the Court to question whether an act of the Legislative Assembly has any legal basis or otherwise, any act of the Assembly which is supported by any legal basis would be immuned from such scrutiny.

In all the articles written about his decision on the net, Justice Ariff was vilified by all and sundry, especially by the supporters of DAP or the Pakatan Rakyat. Some even called him stupid. Some others even questioned his impartiality.

Last week, in yet another high profile case, Justice Ariff held that MACC did not have the power to interrogate witnesses or potential witnesses after office hours. He then ruled that MACC's action in interrogating a potential witness at night was illegal and ordered compensation to be assessed and paid to the victim.

In doing so, Justice Ariff was of course interpreting the law as it is stated in the MACC Act. That Act says any person served with an order shall attend for examination and shall continue to do so "from day to day until the examination is completed" (section 30 (3) (a) of the MACC Act.

As the words "day to day" was not defined by the Act, Justice Ariff applied the literal meaning to the word and came to the conclusion that MACC does not have the right to force any person to give statement at night. Justice Ariff applied the law as he understands it. He applied the law as it is worded.

Many articles were also written about this decision, whether in the mainstream mass media or the net. The IGP made some statement which effectively ridiculed Justice Ariff's decision. The chief of MACC, while saying that MACC would abide by the ruling, was also sulking and whining like some small girls whose lollipop has been taken away.

This time the Pakatan Rakyat supporters hailed Justice Ariff as a hero of sorts. He was seen as a learned Judge who protects fundamental liberties. All the vilifications he received just after Gobind's case were quickly forgotten.

But, as I have said at the start of this article, there is no justice in this world. There is always one side which would say justice has not been served. My fellow blogger Rocky posted an article on his blog about Justice Ariff's decision. He somewhat said that Justice Ariff's decision is weird. Exactly, this is how he puts it:

"Well, I agree with blogger Syed Akbar Ali that in this case, the Court has acted really weird."

Apparently, the Scotland Yard, ICAC and Interpol could take statements at night. So, why not MACC? I must confess I do not know whether that is right. And I do not know what the law governing those bodies provide in terms of taking witness statements. I would also refrain from analysing whether MACC is comparable to all those bodies in terms of performance and ethics.

Whatever it is, Justice Ariff's decision will be appealed by the Attorney General. So, let's not go into the merit of it for the time being.

The point is the comments made under Rocky's article. This time, Justice Ariff is again vilified, especially by commentators who are obviously pro-government. One of the commentators noted that Justice Ariff is a former PAS legal advisor. He then concluded that "something is not right." Basically he was insinuating that Justice Ariff was being dishonest.

Another commentator asked whether Justice Ariff had any problem with the MACC. Perhaps the most unfair comment was this:

A Judge's good work will only last and be appreciated until his next decision which is unfavourable to the relevant party. That is obvious. Many of us have somewhat forgotten how Justice Ariff had conducted himself in accordance with the best tradition of the Judiciary. When the Nizar v Zambry case was fixed for hearing before Justice Ariff, he quickly made it known to all parties that he was a PAS legal advisor. He then invited arguments on whether he should disqualify himself. He later disqualified himself from hearing that case after listening to all parties interested.

That was how conscientious Justice Ariff was.

In Gobind's case he ruled against Gobind. What did that say about Justice Ariff's impartiality, considering that he was a PAS advisor? And now in the MACC case, he applied the law as he understands it. In doing that, he held against the MACC, and consequently the government.

To half of the world, he dispensed justice in all those cases. To the other half, he was a dishonest and partial Judge.

I think I have made my point.
